A. The city attorney shall assist and advise the city government in legal matters. The city attorney shall represent the city in all civil litigation and criminal prosecution except:

1. Where a separate legal counsel is required because of insurance defense requirements, conflict of interest, or other reason as determined by the council; and

2. In minor civil and criminal matters where the city, with the approval of the mayor and city attorney, may be represented by a non-attorney, city employee, or agent. (Prior code § 2.32.020)
