A. The following shall constitute a violation of this chapter:

1. Failure to properly install, certify, repair or maintain a backflow prevention assembly, as required by this chapter.

2. Removal or bypass of a required backflow prevention assembly.

3. Failure to make premises accessible for inspection, as required by this chapter.

4. Failure to timely report the results of testing and inspections as required by this chapter, in the form and as directed by the director of public works.

5. Having an unprotected cross-connection exist on premises.

B. Water service will be discontinued after reasonable notice to the customer if a violation of this chapter exists on the premises. Water service will be discontinued if the proper backflow prevention assembly is not installed or not tested at least annually or not repaired when the assembly fails to meet minimum design standards. Water service shall not be restored until the cross-connection hazard has been eliminated in compliance with the provisions of this chapter.

C. In addition to the remedies provided in this section, remedies and penalties for violations of this chapter are as provided in WMC 1.20.030.

D. Each act or omission in violation of this chapter, and each day in which the act or omission occurs, is a separate violation of this chapter.

E. All remedies for violations of this chapter are cumulative and are in addition to any other existing at law or in equity. (Ord. 24-05 § 3, 2024; Ord. 09-31 § 7, 2009)
